Terminology Definition
Within the scope of these General Terms of Use, the following words should be understood as specified:
Application: The Hive application, available on the Apple App Store, Google Play Store, and AppGallery stores: Hive: https://dating.azve.net
GTS: These General Terms of Use.
Member: A person registered in the Application. Members include Subscribers.
Members: A member registered in the Application whose gender is male/female according to the population registry.
Member's Characteristics: Information provided by the Member about themselves, describing their lifestyle and characteristics. Hive does not guarantee the accuracy of this information. Member statements are assumed to be true. The Member can choose the information they want to be visible on their profile and filter other Members in the Application based on this information.
Search: A page where members appear based on distance.
Skip: An action represented by an icon indicating disinterest or dislike. This action is hidden, and no notification is sent. "Skipped" profiles may reappear in the Member's content feed in the future. Liked or matched members can be selected for viewing in the filter.
Like: An action represented by an icon indicating interest. This action is not hidden, and a notification is sent to the "Liked" profile.
Crush: Triggered by a Like from both profiles. If both profiles like each other, a Crush (Match) occurs, and both members are notified. It represents mutual interest.
Highlight: While this option is active, it shows the Member's profile at the top, in a specified location, as a focus of interest.
Messages and voice messages: Members can chat with each other in the Application by selecting the "Chat" action based on preferences. They can choose to chat with friends or everyone.
Packages: Paid features purchased in advance by Members. (If these purchases are canceled or refunded, the Member's profile and privileges are suspended.)
Profile photos: Profile photos that allow the Member to be easily recognized. In this context, the Member agrees to publish at least one clearly recognizable photo of their face in the first position. Hive has the right to review these photos and remove photos that do not contain the Member's face.
Video/voice calls: Services offered by Hive, either paid or free, to support virtual or real meetings between Members who have shown mutual interest and purchased packages.
Highlight: A function that allows the Member to pin their profile and become a focus of interest.
Hive Pro: Paid services offered by Hive on a monthly basis.
Hive Ghost: A paid service that hides profile visits.
Account: A personal space allocated to the Member in the Application, accessible by registering and connecting to the Application. It allows the Member to access Services. A Member can only have one Account.
Facebook Connect: A feature that allows Members to use their Facebook accounts to identify themselves in the Application, simplifying the registration process.
Attractiveness: An optional game offered by Hive to users. A Like is sent to the selected person from the suggested profiles.
Article 1: Scope of Application
The General Terms of Use define the rights and obligations of the parties within the framework of the use of the Application. It mediates the contractual relationship between the Member and Hive.
1.1 Conflict of Norms
These General Terms of Use (GTS) define the basic rules of use for the Application. Additional policies (Privacy Policy, Cookie Usage, and Trust Statement) complement these terms to guide the Member in the most accurate way in the use of the Application. In case of a conflict between different policies that may lead to blocking access to the rules, misunderstanding, and/or unpredictability, these General Terms of Use take precedence over the Privacy Policy, Cookie Usage, and Trust Statement.
1.2 Independence of Conditions
If any condition in these General Terms of Use is declared invalid or unenforceable by a law, regulation, or a decision of an authorized judicial authority, only the relevant condition is removed; the other conditions remain valid and retain their authority, provided that the removal does not distort these General Terms of Use or create significant imbalances in the obligations of the parties.
Article 2: Changes to the General Terms of Use
2.1 Update
Hive reserves the right to unilaterally supplement or modify these General Terms of Use as it deems necessary or to terminate the Services.
The Member will be informed of updates to the General Terms of Use through the Application and/or by email sent to the address provided by the Member. It is the Member's responsibility to ensure that this email address is valid.
It is the Member's responsibility to carefully read the updated General Terms of Use and fully understand the changes brought by the updates.
The Member's continued use of the Services offered by the Application after the update of the General Terms of Use implies unconditional acceptance of the changes by the Member.
If the Member does not approve the changes to the General Terms of Use, the Member has the right to terminate the Services and delete their Account in accordance with Article 14.3.
2.2 Immediate Application
Each new version of the General Terms of Use is immediately applicable to Members.
Article 3: Applicable Law and Dispute Resolution
3.1 Applicable Law
These General Terms of Use are subject to the substantive law of the Republic of Turkey, excluding all conflict of law rules.
3.2 Dispute Resolution
In case of a dispute, the Member undertakes to directly contact Hive in writing (via email or mail to the address specified in Article 15 of these General Terms of Use) before initiating any judicial or extrajudicial process to resolve the dispute amicably.
If unsuccessful, the Member may resort to free mediation and submit any complaints to the dispute resolution platform published by the European Commission at the following internet address: http://ec.europa.eu/consumers/odr/.
Any objection or dispute not resolved by amicable settlement regarding these General Terms of Use or their formation, interpretation, application, or termination shall be submitted to the competent judicial authorities of ISTANBUL (TURKEY).
Article 4: Registration
4.1 Methods of Installing the Application
The Application is available for free on legal Apple, Huawei, Xiaomi, Samsung, Amazon, and Google download platforms and on the Hive website accessible at: https://dating.azve.net. The Application can be downloaded for free from the specified app stores for iPhones with iOS 10 or later and Android smartphones with version 5 or later.
4.2 Member's Right to Register
When the necessary conditions for Member status are met, Hive allocates a personal Account to the Member, which includes:
• Username
• Inbox
• "Notification" option
• Member ID
A Member can only have one Account. Hive reserves the right to close multiple accounts.
4.3 Member's Obligations for Registration
The Member must be at least 18 years old and guarantee that all information provided during registration is accurate and up-to-date.
The Member must be over 18 years old and check the box indicating that they are over 18 years old on the re-login screen for NSFW content (this content will be removed upon detection and complaint).
Registration can be done through the following alternative methods:
- Via mobile phone number: in this case, no information about the Member is automatically obtained; it is the Member's responsibility to provide all relevant information, including name, gender, date of birth, and any additional information they wish, as well as one or more photos of themselves during registration.
- Via Apple or Google Sign in: it is the Member's responsibility to provide all relevant information, including name, surname, gender, date of birth, and any additional information they wish, as well as one or more photos of themselves during registration.
- Via Hive, Phone, or Google Sign in.
The Member agrees to approve these General Terms of Use and the Privacy Policy during registration and to comply with their obligations, particularly the Member's Code of Conduct specified in Article 8 of these General Terms of Use.
Article 5: Services and Functions
5.1 Purpose of Services
The Application offers Members profiles based on their search preferences, profile activities in the Application, Characteristics, favorite places, or locations. The Member may not be able to change the recommendation criteria. We believe that these criteria are highly likely to determine your compatibility with the profiles offered by the Application.
The Services offered by Hive cannot be used for marriage counseling or matchmaking activities. These Services are solely aimed at facilitating virtual or real meetings between Members who have mutual interest through the Application based on location and preferences.
5.2 Services for Members
Some Hive Services can be used for free by the Member on the Application (excluding connection and telecommunication fees) provided that the Member commits to comply with these General Terms of Use. Some of these services include:
• Sending a limited number of Likes.
• Sending Messages, Voice Messages, Photos, or Videos based on the other Member's choice.
• Viewing other Members' profiles.
• Skipping/Liking numerous profiles.
• Blocking Members who have legitimate reasons based on their behavior, within the framework of privacy.
• Reporting Members who violate these General Terms of Use or applicable laws, within the framework of privacy.
• Accessing the list of Members who have Liked/Visited.
• Editing search preferences.
• Receiving notifications.
• Accessing FAQs and tutorials.
• Completing the profile within the framework of these General Terms of Use.
• Deleting messages.
Paid Services offered through the Application can be accessed by Members who have purchased Packages or Hive Pro and packages, as explained in Article 9.
Article 6: Protection of Personal Data
Hive places great importance on the protection of your personal data and privacy. To learn how we process your personal data, we recommend that you review the Privacy Policy and Trust Statement accessible through the following links:
Article 7: Hive's Obligations and Responsibilities
7.1 Technical Capabilities and Security
Hive is obliged to provide the necessary infrastructure and technical capabilities to provide quality service to Members with iPhones running iOS 10 or later and Android smartphones with version 5 or later.
Hive cannot be held responsible for operational errors on the Member's phone or incompatibility issues between the phone and the Application.
Additionally, all necessary measures have been taken to minimize the risk of unauthorized access to the Hive system. For this purpose, Hive uses firewalls and equipment located between the Internet network and a company's private network to filter incoming and outgoing traffic to enhance security. However, absolute security of a network cannot be guaranteed.
Hive is not responsible for any failure, interruption, or malfunction in the services of the Member's internet provider or any external cause that may prevent or harm access to Hive.
The Member must have a secure messaging address. Despite these measures or if these measures are ignored, the Member's Account may be subject to fraud, no matter how unlikely this possibility may be.
Hive also warns Members about the risk of receiving unwanted messages or messages from addresses claiming to be Hive. The Member must be careful and cautious to avoid being a victim of fraud and, if necessary, inform Hive by sending a letter or email to the address specified in Article 15.
7.2 Illegal Activities
Hive and its partners cannot be held responsible in any way for actions committed by Members that may be subject to fines and criminal penalties. Some of these actions include:
• Any type of fraud
• Any type of commercial or professional activity
• Prostitution
• Identity theft
• Violation of third-party intellectual property rights
• Violation of personality rights such as personal image rights and privacy rights.
• Such actions may result in the suspension or termination of the Account under Article 14.4 of these Terms of Use.
7.3 Complaint and Community Moderation System
As a hosting provider, Hive is not legally obligated to monitor content transmitted or stored through the Application under Article 6.I-7° of the Digital Economy Privacy Law dated June 21, 2004.
However, Article 6.I-3° of the same law requires Hive, as a hosting provider, to establish a notification system for reporting illegal, malicious, and harmful content.
In such cases, Hive commits to promptly remove the relevant content after review by Customer Service.
According to Article 6.I-5 of the Digital Economy Privacy Law, the following points are considered to be known to the hosting provider when reported:
• Date of notification
• Identity of the person disseminating the content
• Description of the disputed elements and their exact location (with the option to include screenshots of the disputed content);
• Legal provisions and concrete evidence, as well as reasons for content removal;
• A copy of the correspondence sent to the author of the disputed content requesting its removal or modification, or evidence that the author could not be contacted;
• A statement confirming that the notifier acted in good faith and believed the information to be accurate and complete.
In this regard, Hive has equipped the Application with a community moderation system. This allows Members to report content that violates the Digital Economy Privacy Law, particularly content that promotes crimes against humanity, racial hatred, gender, sexual orientation, or identity-based hatred, and especially child pornography, incitement to violence, incitement to violence against women, and violations of human dignity.
Hive teams, acting under strict professional ethics, place great importance on this complaint procedure, which also applies to statements against decency rules, and refuse to be associated with aggressive and rude Members as well as illegal, malicious, and harmful content and discourse.
Therefore, when content published by a Member leads to such a complaint, the Member's Account may be suspended or even terminated under the conditions specified in Article 14.4 of this document, based on the evidence provided by the complainant and in accordance with Hive's legal obligations to remove illegal content.
The identity of the complaining Member is never disclosed.
Outside of this complaint procedure, Members have the option to block another Member whose behavior does not comply with decency rules, thereby cutting off all communication with that Member (mutual Likes, Messages, and Voice Messages are no longer accessible or can be sent in the future, and the blocked Member is not notified of their existence, especially if the Member is being harassed in any way by the blocked Member). This process is not hidden and allows Members to manage which Members they want or do not want to be in contact with. This complaint system is accessible and functional:
• On iPhone, at the top right of the Member's profile photo and at the top right of the chat screen with the relevant Member.
• On Android smartphones, at the top right of the Member's profile photo and at the top right of the chat screen with the relevant Member.
In cases where content is published that may be considered a crime under applicable laws and regulations, the Member who is the victim of such content must also apply to the competent authorities.
The complaint procedure implemented by Hive does not in any way replace a possible legal complaint and procedure against the Member who published the reported illegal content.
Misuse of the complaint system (unjustified and malicious complaints) also constitutes a violation of these General Terms of Use and may result in the suspension/termination of the Member's Account under Article 14.4 "Suspension/Termination of a Member's Account by Hive in case of violation of the Terms and Conditions of Use" and may also lead to criminal penalties and compensation to victims under Article 6.I-4 of the Digital Economy Privacy Law.
In addition, Hive takes measures to support the peace and security of its Members on the Application in accordance with the Privacy Policy.
7.4 Precautionary Rules
The Member is responsible for verifying the identity of the persons they will organize a "real" meeting with. Hive cannot be held responsible in any way for any problems that may occur during a "real" meeting.
Similarly, the Member is responsible for verifying the identity of the Match they choose to communicate with via Video Call and organize a "virtual" meeting. Hive cannot be held responsible in any way for any problems that may occur during a "virtual" meeting.
7.5 Mass Demonstration
Any use of Hive Services to organize mass gatherings among Members falls under the use of the Service for other purposes. Therefore, it is strictly prohibited to plan and organize demonstrations in public spaces using the Application. If such a demonstration occurs, Hive cannot be held responsible for any disruption of public order or any damage caused by such demonstrations.
Article 8: Member's Code of Conduct
8.1 Honesty and Compliance with Rules During Registration
To become a Member, all of the following conditions must be met:
• Being of legal age as defined by Turkish laws (over 18 years old).
• Completing personal information on the Application directly if registered via Facebook profile, mobile phone number, Apple or Google Sign in, or Hive Web, in a sincere and accurate manner. The Member must declare the name, gender, and date of birth as written on their identity card. Otherwise, the Member is obliged to correct incorrect information on their Facebook profile and enable synchronization between the Facebook profile and the Account. The Member is also obliged to provide a valid email address.
• Continuously updating the information provided on the Application Account.
• Having read and accepted these General Terms of Use when approving the registration process.
Hive has neither a legal obligation nor the technical means to verify the identity and age of Members. However, in case of suspicion of identity fraud or fictitious or incorrect information, the presence of suspicious elements, or a complaint by a third party through the "complaint" function, Hive will initiate an investigation as soon as possible and, if necessary, correct the reported information without distorting the Member's profile.
During the investigation, Hive reserves the right to suspend the suspicious Member's Account and access to the Application and to request a photocopy of the official identity card to conduct the necessary checks.
If the Member cannot provide the required written evidence or if there is evidence of a violation of these General Terms of Use, Hive may terminate the Member's Account under the conditions specified in Article 14.4 of this document.
The Member undertakes to use only one account. Otherwise, Hive may terminate subsequent accounts under the conditions specified in Article 14.4 of this document.
8.2 Honesty and Compliance with Rules During Use
To remain a Member, all of the following conditions must be complied with:
• Being honest and sincere in declarations.
• Publishing only photos and/or profile information that allows the Member to be easily recognized, and at least one profile photo where the face is clearly visible in the first position, as previously explained. These two criteria are essential for the use of the Services. Additionally, photos and/or profile information should not contain third parties or elements unrelated to the Member; otherwise, Hive reserves the right to remove photos and/or profiles that do not comply with these conditions at its discretion.
• Not publishing confidential information belonging to others, such as financial data.
• Not publishing pornographic or inappropriate content and photos that violate human dignity on the Application.
• Respecting the private nature of content and Messages and Voice Messages shared with other Members on the Application and, accordingly, not disseminating the content of these Messages to third parties.
• Not violating intellectual property rights and personality rights regulations.
• Not disturbing public order.
• Not committing defamation and, more broadly, not making insulting statements, particularly regarding race and discrimination.
• Complying with applicable laws and regulations.
• Not inciting violence or racial hatred; not defending terrorism, war crimes, or crimes against humanity.
• Not violating decency rules and behaving properly towards other Members.
• Not harming the normal operation and infrastructure of the Application's Services in any way.
• Not modifying, copying, collecting, compiling, or attempting to use the source codes, algorithms, and software of the Application and Hive's partners outside the scope of these General Terms of Use, particularly for reverse engineering purposes.
• Not using robots or tools other than those provided by Hive when communicating with others on the Application.
• Not using the Application for professional service purposes (escort or similar services).
• Not contacting other Members for the purpose of advertising paid products or services.
• Not sharing connection information, especially the Account password and identity information, with other Members.
• Not advertising or promoting any other service, whether competitive or not, in any way, and not creating unfair competition.
• Not using the Application for meeting or demonstration organization purposes.
The Member is prohibited from copying, publishing, and/or transmitting any technical data captured on the network related to the Hive Application.
Additionally, if the Member engages in clearly malicious or excessive behavior to use the paid Services offered on the Application for free, especially if this behavior is repeated and/or unfounded, Hive reserves the right to suspend the Member's Account under Article 14.4 of these Terms of Use.
Members also undertake to comply with the following terms of use:
• Not transmitting, sharing offensive, sexual, illegal, dangerous, violent, harassing, disrespectful, defamatory, or threatening fixed and/or moving content;
• Not using the messaging function under the following conditions:
(i) for money, chance, gambling, raffle games, or competition purposes;
(ii) for promoting, encouraging, or facilitating any activity that violates the rights of third parties (including but not limited to: intellectual and industrial property rights, privacy, and personality rights);
(iv) attempting to use the function for purposes other than its intended purpose, such as using it for purposes other than instant calls and meetings with the Member they are in contact with via Video Call, or attempting to bypass the function's security measures.
8.3 Personal Use
The Member undertakes to use the Application only for personal purposes. The Hive network cannot be used for commercial, advertising, political election, or recruitment purposes. It is strictly prohibited to send marketing and/or commercial Messages and/or newsletters containing content, signs, or links directing to third parties, especially Hive's competitor companies, through the Application's messaging system.
8.4 Member's Responsibility
The Member is solely responsible for their actions and the data they publish through the Application.
If Hive is held responsible for the Member's failure to comply with their obligations, the Member does not hold Hive responsible for any judgment, appeal, or penalty imposed on them due to their violation of the law or these General Terms of Use.
The Member can report illegal content that violates laws and regulations or these General Terms of Use by using the complaint tools provided by the Application, as per Article 7.3 of these General Terms of Use.
8.5 Photos
All pornographic, exhibitionist, or inappropriate photos and, in general, all photos contrary to morality are strictly prohibited. Publishing such photos is considered a serious misconduct and may result in the suspension and/or termination of the Member's Account, in addition to other penalties that may be imposed by the judiciary.
8.6 Real Meetings
Hive warns Members who wish to meet "in real life." The Member is entirely responsible for verifying the identity of the persons they will organize such a meeting with. Such meetings organized after the use of the Application are entirely under the responsibility of the Members, independent of Hive. Hive cannot be held responsible for any incidents or problems caused or provoked by Members and/or former Members during such meetings. In this regard, the Application's messaging system provides the best advantages by allowing Members to decide who can view their profile and who they can chat with, aiming to protect the comfort and safety of Members.
It is strongly recommended that Members do not provide personal information such as phone numbers, addresses, or surnames that are not included in the Application profile to the persons they accept to chat with. As a security measure, Hive strongly recommends that real encounters take place only in crowded public places or that a relative is informed about the meeting and that contact information is only provided after a reasonable period of time.
8.7 Account Management
The Member must regularly check their inbox and notifications. Hive communicates information about its Services and any changes and updates it makes through these channels. This information can also be sent to the email address provided by the Member during registration via Facebook Connect, mobile phone, Apple, Google Sign in, or Webapp Hive.
The Member can access the Services related to their Account by connecting to the Application using their username and secret password. The Member is solely responsible for these connection details and must ensure that no third party has access to them. In particular, the Member guarantees Hive for all communications or transactions made through their Account and all declarations.
8.8 Equipment
All equipment (hardware or software) necessary for accessing the Service and all related costs, including communication costs, are entirely the Member's responsibility. The Member is solely responsible for the hardware used within the scope of the Service.
Article 9: Paid Services
9.1 Purchase of Hive Pro, Ghost, etc.
Features can be purchased at the specified prices from the app stores/website. They cannot be obtained from third parties.
A SuperCrushs Package is gifted to the Member when they register on the Application.
Additionally, any Member can switch to a Hive Professional subscription at any time.
Subscribers have access to additional services exclusive to subscribers, in addition to the free services.
Subscription options grant access to Hive Premium and Hive Supreme for the duration of the selected subscription.
Eligible Members may be offered a promotional offer for a Hive subscription when they register. This offer is limited to the period specified in the offer. This offer is personal and is valid only once per Apple or Google Play account, depending on your device, for first-time Hive subscribers.
9.2 Purchase of Message Package (if applicable)
Message packages, which include multiple message rights, can be purchased as a Package at the specified prices from the Apple App Store, Google Play Store, and Stripe platform.
9.3 Purchase of Highlight
Highlights can be purchased individually at the specified prices from the Apple App Store, Google Play Store, and Stripe payment platform.
9.4 Payment Options
Payment is for a certain period from the date the contract is concluded.
Payment via your App Store or Play Store account. The payment process is processed and managed by Apple App Store or Google Play Store, depending on your device.
Hive has no control over payment, currency exchange, or fund transfer transactions, as well as any possible costs covered by these transactions. Therefore, the sole responsibility for payment terms and transactions lies with Apple App Store and Google Play Store.
Therefore, Hive does not have the ability to refund your purchases. In case of possible refunds, memberships and privileges acquired after payment are terminated. Any request regarding payment must be directed to the Store where you made the purchase.
Hive does not collect any banking data. Your banking information is collected and processed directly by Apple or Google and is not under Hive's control.
Payment by bank card. Payment by bank card is possible on the Web Application and Android Mobile Application. It is managed through the Stripe payment platform. Any request regarding payment via the Web Application must be directed to Hive's customer service department.
Hive does not collect any banking data. Your banking information is collected and processed directly by Stripe.
9.5 Duration of Hive Contract and Subscription Renewal
If the Member chooses a Hive Premium subscription, they commit to it from the moment of subscription and for the entire duration of the selected subscription. If the Member cancels before the end of the commitment period, the amounts paid to Hive for this period will be retained by Hive and will not be refunded to the Member.
Subscriptions are automatically renewed by default unless the Member objects using the specific function on the platform where they purchased the subscription (Apple App Store, Google Play Store, or the Application).
In case of subscription renewal and upon receipt of the payment made
Hive will automatically confirm your purchase from your Store and update your account to give you access to Hive Premium or Supreme for the duration of the subscription.
If you do not wish to choose the "Renewable subscription unless otherwise requested" option, it is sufficient to follow the instructions provided at the following link to disable this option
Therefore, if you wish to cancel the automatic renewal applied by the Stores at the end of the subscription period, you must disable this option.
9.6 Right of Withdrawal
As specified in Article 9.5 of these General Terms of Use, all payment transactions are processed and managed by Apple App Store or Google Play Store. Similarly, the right of withdrawal, if applicable, can be exercised directly through the App Store or Google Play.
For this, if a Member decides to exercise their right of withdrawal, they must inform the situation to Apple App Store or Google Play Store, depending on the type of device used during the purchase:

For payment by bank card. You must inform Hive that you have exercised your right of withdrawal.
9.7 Early Termination of the Contract by the Member or Hive
In case of violation of these General Terms of Use or a legal regulation by the Member, Hive has the right to terminate the contract immediately and without violating any rights. Hive is not obliged to prove its decision to terminate to the Member.
In any case, no refund is made to the Member who has benefited from Hive or purchased a Package.
Article 10: Scope of the Campaign
10.1 Pro Membership Validity Period
The Pro membership purchased and/or gifted by Hive can be renewed as long as the Account is active in accordance with these General Terms of Use. Features are for specific/limited periods. They are not unlimited. In case of early termination of the Account under Articles 14.3, 14.4, or 14.5 of these General Terms of Use, the Member's privileges in their Account are permanently deleted without any compensation as of the day the Account is terminated or deleted.
The Member cannot regain the lost privileges if they re-register later.
Hive may decide to gift privileges to Members within the scope of a loyalty program or a special offer.
10.2 Accumulation of Advantages
Privileges can be used cumulatively. The number/duration of privileges in each Package purchased is added to the number/duration of privileges previously recorded in the Member's Account.
Privileges or subscriptions can also be used cumulatively; Subscribers allow Members to use more privileges than they benefit from.
Article 11: Communication with the Member
11.1 Push Notifications
The Member may receive Push notifications through the Application; thus, they can be informed of important events, including but not limited to:
• A Like sent by another Member
• A Message or voice message sent by another Member
• A message sent by Hive regarding the Member's Account and/or Services.
The Member can adjust their preferences regarding Push notifications from their Account.
11.2 Newsletter
When the Member registers on the Application, Hive sends them a newsletter. The Member can cancel their subscription to the newsletter at any time by clicking on the "unsubscribe" link in the newsletter and/or by exercising their right to object by sending an email to the address specified in Article 15 of these General Terms of Use.
11.3 Advertising and Promotional Messages
Within the scope of the execution of the contract and through the Application, Hive is free to publish advertising and/or promotional messages from advertisers and other partners.
Article 12: Intellectual Property
12.1 Brand Rights Concessions
The Hive brand is the exclusive property of Hive. Hive owns all rights related to it.
Without limitation, for example, the reproduction and/or use and/or partial or total attachment and/or modification and/or deletion of the brand and related rights, including but not limited to slogans and logos suggested by the Application, in any way, in any form, through any medium, and via any media, without the express and written permission of Hive, is strictly prohibited and may be subject to legal proceedings.
12.2 Copyright Concessions
Original works provided by Hive are the exclusive property of Hive. Hive owns all rights related to them.
The representation and/or copying and/or publication and/or partial or total use of the Services and content provided by the Application, including but not limited to software, animations, texts, photos, videos, graphics, and more broadly the general structure, in any way, in any form, through any medium, and via any media, without the express and written permission of Hive, is strictly prohibited and may be subject to legal proceedings.
These original works are also protected by Articles L.335-3 and following of the Intellectual Property Code currently in force in France and applicable worldwide.
12.3 License
The usage rights granted by Hive to the Member are for private and personal use. The use of these rights by the Member in other ways without the express and written permission of Hive is prohibited.
The Member grants Hive and its partners a non-exclusive, worldwide, and perpetual license to use, reproduce, represent, modify, and translate, partially or completely, free of charge, any element based on intellectual property rights and personality rights (including visual rights, name, and voice rights) (text, photo, video, etc.) provided by the Member to Hive through the Application to support communication efforts with other Members.
This license will be used by Hive within the framework of respect for the Member's visual rights, personality traits, privacy rights, and personal data protection, without distorting the accuracy of the Member's profile and remaining faithful to the profile. This license allows Hive to adapt these elements to technical performances or the formats of the relevant media. These rights are granted worldwide for the duration of the execution of these General Terms of Use between the Member and Hive.
The Member remains the owner of the content and personal data they provide.
The Member indemnifies Hive against all legal proceedings, appeals, or penalties imposed on them due to the violation of third-party intellectual property rights or personality rights. The Member indemnifies Hive against all complaints and damages resulting from this situation, including but not limited to compensation claims.
Within the scope of the profile suggestion service, the Member grants Hive the same usage rights and guarantees as mentioned in the above license for the three profiles selected as examples to be sent to other Members through the Application and editorial or thematic newsletters sent by email; this suggestion list may differ from the list the Member will find on their profile in the Hive Application, as profiles are continuously filtered based on their consistency and status.
Article 13: Fraud, Unfair Competition, and Freeloading
It is strictly prohibited to design a product similar to the Application or create a derivative of it and, more generally, to engage in any type of crime that constitutes freeloading, imitation, defamation, or unfair competition or fraud. Otherwise, Hive reserves the right to take legal action against the Member to obtain full compensation for the damage caused by the Member.
In addition, the Member may also face severe legal penalties if they attempt or succeed in licensing, sublicensing, selling, reselling, transferring, abandoning, distributing, or using the Services or the Application for commercial purposes or providing them to third parties in any way.
Article 14: Termination of the Contract
14.1 Deactivation of the Account by the Member
The Member can deactivate their Account at any time without prior notice through the Application if they no longer wish to be visible.
With the deactivation of the profile:
• The Member's profile, past and future, becomes invisible to other members.
• It has no effect on the legal obligations regarding data protection.
• If the Account is reactivated within 1 year from the deactivation, the Member regains all their stored data, and the profile becomes visible again.
14.2 Removal of the Application by the Member
The Member can remove the Application from their mobile at any time without prior notice. As a result, the Member cannot access the Application unless they reinstall it.
• When the Application is removed, the Member's account is not deleted. Therefore, it is recommended to delete the account before removing the Application.
• The removal of the Application has no effect on the legal obligations regarding data protection.
• If the Application is reinstalled within 1 year from the removal, the stored Account data is reassigned to the profile, and the profile becomes active again.
• Data is stored for 1 year under all circumstances due to legal situations. However, it is not shown to other members.
14.3 Deletion of the Account by the Member
The Member can decide to permanently delete the Application at any time without prior notice. For this, they can choose one of the following alternative methods:
- By going to the Application's Settings > My Data > Delete My Account sections and deleting it themselves.
- By sending an email or letter to Hive at the postal or electronic address specified in Article 15 of this document.
As a result, the Member's profile, including all purchased content/privileges allocated to their Account, is permanently terminated.
If the Member wishes to start using the Application again after deleting their Account, they must register under the same conditions as when they first registered.
With the deletion of the Account:
• The Member's profile becomes invisible to other members.
• The Member's data is stored for 1 year from this date in accordance with the legal obligations binding Hive, as specified in Article 9 of the Privacy Policy, and is permanently deleted at the end of this period.
• All privileges in the Member's Account are permanently deleted without the possibility of a refund as of the day the Account is deleted.
The Member cannot reactivate their old Account.
14.4 Deletion/Termination of the Member's Account by Hive in Case of Non-Compliance with the General Terms of Use
If the Member does not comply with the General Terms of Use, their Account may be suspended as a precaution at any time and subsequently terminated by Hive in accordance with the law.
Hive may suspend the Member's Account until the necessary checks are made by customer service, in accordance with Article 7.3 of this document, after a complaint or if it is assumed that the General Terms of Use have not been complied with but can be corrected:
• the number of clearly illegal content/notifications or clearly unfounded complaints;
• the relative ratio of these contents to the total number of contents provided or notifications made;
• the seriousness of the abuse (nature and consequences);
• the Member's intention (if determinable).
• Automatic spam/complaint system.
The Member who wishes to obtain more detailed information about the suspension of their Account, to state their possible observations, and/or to provide evidence that the non-compliant conditions have been compensated, must contact Hive customer service. Members can also apply to the internal complaint evaluation system developed by Hive.
If the Member does not contact Hive customer service within 30 days of the notification of the suspension of the Account or if the elements presented by the Member to customer service do not compensate for the violation, Hive may inform the Member through the Application and/or by email that their Account has been terminated and how long they can re-register on the Application. If no definitive information is provided, this period is determined as 1 year from the notification of the termination of the Account.
With the termination of the Account:
• The Member's profile becomes invisible to other members.
• The privileges registered in the Member's Account are permanently deleted without the possibility of a refund as of the day the Account is terminated.
The Member cannot open a new Account for a maximum period of 1 year from the notification of the termination of the Account.
14.5 Termination of Inactive Accounts by Hive
Hive deletes Accounts that are inactive as described below.
An Account is considered inactive if it meets the following two criteria continuously for 1 year:
• The Member's Application has not connected to Hive servers (especially because the location determination option is disabled) and;
• The Member has not used the Application. In any case, an Account of a Subscriber Member is not considered inactive.
The Member is informed by email to the address they provided to the Application with an 8-day notice that their Account has been deleted.
The Member can reactivate their Account at any time during the notice period, thus stopping the termination procedure. The Member retains all their profile content.
At the end of this notice and if the Member does not show up, Hive automatically deletes the Account.
With the deletion of the Account:
• The Member's profile becomes invisible to other members.
• The Member's data is stored for 1 year from this date in accordance with the legal obligations binding Hive, as specified in Article 9 of the Privacy Policy, and is permanently deleted at the end of this period.
• The privileges registered in the Member's Account are permanently deleted without the possibility of a refund as of the day the Account is terminated.
The Member cannot reactivate their old Account and cannot request its reactivation.

Article 16: Confidentiality Clause
Neither Hive nor the Member is authorized to disclose the information in the contract binding them in case of a dispute, and both parties undertake to comply with the confidentiality clause, which obliges them to prefer confidential negotiation in case of disagreement.
